ORDINANCE NO. G-458

AN ORDINANCE RELATING TO THE KEEPING OF ANIMALS WITHIN THE CITY LIMITS OF THE CITY OF HARPER, KANSAS, AND AMENDING SECTION 6-243 OF THE CITY CODE OF THE CITY OF HARPER, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF HARPER, KANSAS:

SECTION 1: That Section 6-243 of the City Code of the City of Harper shall be amended to read as follows: 

6-243. KEEPING OF ANIMALS.

a) Prohibited animals. Except as expressly provided in subsection (c), it shall be unlawful for the owner, lessee, occupant or person in charge of any premises within the city limits to own, possess, harbor, keep or maintain any livestock on such premises, or to permit any stable, shed, pen, enclosure or other place for keeping livestock to be maintained thereon.  

b) Livestock defined; For the purposes of this section, livestock means any animal of a type traditionally raised or kept for agricultural purposes, food, dairy products, fiber, breeding, draft, or similar purposes, including but not limited to, horses, ponies, donkeys, mules, cattle, bison, sheep, goats, swine, alpacas, llamas, chickens, turkeys, ducks, geese, guinea fowl, peafowl or other poultry or fowl. The term includes miniature, dwarf and pot-bellied breed or varieties. An animal that falls within this definition remains livestock regardless of its size, breed, domestication, training, living arrangement, the purpose for which it is kept, or whether its owner considers or treats it as a pet or companion animal. 

c) Exceptions. The prohibitions in this section shall not apply to the following:

1. A stockyard, sales barn or commercial holding pen used for the loading, unloading, temporary detention and sale of livestock, provided its location and operation comply with zoning ordinances and all other applicable laws of the city. 

2. The temporary transportation of livestock through the city by ordinary and customary means, provided the animals are not unloaded or kept within the city except as reasonably necessary during an emergency. 

3. Persons owning or maintaining livestock on property that abuts the corporate limits of the city, subject to the limitations on fowl contained in paragraph (4). Livestock permitted under this paragraph shall not be kept within 100 feet of any dwelling house or residence of any person, excepting the owner or keeper of the livestock.

4. The keeping of not more than 15 fowl, excluding roosters, guinea fowl and peafowl, in pens, enclosures or shelters maintained in accordance with sections 6-247 and 6-248. Fowl shall not be kept within 20 feet of any dwelling house or residence other than the dwelling house or residence of the owner or keeper of the fowl. 

SECTION 2: That Section 6-243 of the City Code of the City of Harper, Kansas, is hereby amended. 

SECTION 3: This ordinance shall take effect and be in full force from and after its passage and publication in the official newspaper.
