ORDINANCE NO. 513

AN ORDINANCE OF THE CITY OF MEDFORD, GRANT COUNTY, OKLAHOMA AMMENDING THE CITY OF MEDFORD MUNICIPAL CODE TO SET FINES FOR VIOLATION OF SPEED LIMITS ON THE HIGHWAYS, STREETS AND ALLEYS WITHIN THE CORPORATE LIMITS OF THE CITY OF MEDFORD; DEFINING TERMS USED IN THIS ORDINANCE; PROVIDING FOR DOUBLING OF FINES IN SCHOOL AND CONSTRUCTION ZONES; PROVIDING FOR REPEALER AND SEVERABILITY; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MEDFORD, OKLAHOMA AS FOLLOWS:

Section 1. Definitions

A) “City” shall mean the City of Medford, Grant County, Oklahoma.

B) Highway” shall mean those portions of US-81 and OK-11 highways within the corporate limits of the City.

C) “Street” shall have the same meaning as defined in Section 2.2 of Appendix A of the Medford Municipal Code. For purposes of this ordinance, Street shall also include

1. Alley as defined in the same section; and

2. Those portions of County Road 960, also referred to as Front Street, within the corporate limits of the City; and

3. Those portions of Haskell Road within the corporate limits of the City; and

4. Those portions of Harper Road within the corporate limits of the City.

Section 2. Vehicle Operation

A) Any person operating a vehicle on a street or highway shall drive at a careful and prudent speed not greater than nor less than is reasonable and proper, having due regard to the traffic, surface, and width of the street or highway and any other conditions then existing. No person shall operate any vehicle upon a street or highway at a speed greater than will permit the operator to bring it to a stop within the assured clear distance ahead.

B) No person shall operate a vehicle on a street or highway at a speed in excess of the posted limit, except as otherwise permitted by law or ordinance.

C) Except when a special hazard exists that requires lower speed for compliance with subsection A of this section, no person shall operate a vehicle on a street or highway at a speed in excess of twenty-five (25) miles per hour unless otherwise posted.

D) Where any portion of a street or highway is a properly marked school zone, as indicated with appropriate warning signs placed in accordance with the latest edition of the Manual on Uniform Traffic Control Devices, and a reduced speed limit as properly posted, shall be in effect during certain times due to the presence or potential presence of school children, no person shall operate any vehicle upon that portion of the street or highway which is the school zone in excess of the reduced speed limit so posted when the reduced speed limit is in effect. Violation of the posted reduced speed limit in the school zone shall result in the doubling of the appropriate fine.

E) The Public Works department of the City and road maintenance crews of Grant County shall have the same authority as those entities identified by 47 O.S. § 806 to designate a “repair, maintenance, or construction zone” for any highway or street within the city limits when such shall be under construction, maintenance, or repair or when a detour shall have been designated by reason of construction, maintenance, or repairs in progress and a maximum safe, careful, and prudent speed shall have been determined and posted at each terminus thereof by the aforementioned entities, during the period of the construction, maintenance, or repairs.  No person shall operate any vehicle upon any portion of the highway, street or detour at a speed in excess of the speed so posted. Violation of the posted speed limit in the repair, maintenance, or construction zone or the detour shall result in the doubling of the appropriate fine. For purposes of this section, “repair, maintenance, or construction zone” means any location where repair, maintenance, or construction work is actually in progress and workers are present.

Section 3. Fines

A) Any person convicted of a speeding violation pursuant to this ordinance shall be punished by a fine as follows:

1. One (1) to ten (10) miles per hour over the limit $5.00

2. Eleven (11) to fifteen (15) miles per hour over the limit $20.00

3. Sixteen (16) to twenty (20) miles per hour over the limit $30.00

4. Twenty-one (21) to twenty-five (25) miles per hour over the limit $40.00

5. Twenty-six (26) to thirty (30) miles per hour over the limit $50.00

6. Thirty-one (31) to thirty-five (35) miles per hour over the limit $75.00

7. Thirty-six (36) or more miles per hour over the limit $100.00

or by imprisonment for not more than ten (10) days for a third or subsequent conviction within one (1) year after the first conviction, or by both such fine and imprisonment.

B) Any costs or fees provided for by statue, ordinance or resolution shall be in addition to, and not in substitution of, any and all fines and penalties otherwise provided for by statue or ordinance.

Section 4. Repealer.

All ordinances and part of ordinances in conflict herewith are hereby repealed.

Section 5. Severability.

The provisions of this ordinance are severable and if any part or provision hereof shall be

adjudged invalid by any court of competent jurisdiction, such adjudication shall not affect or impair any of the remaining parts or provisions.

Section 6. Emergency.

It being necessary for the protection of the public health, safety, and welfare, the City Council finds that an emergency exists, and this ordinance shall be effective immediately upon passage.
