Notice of Intent to Destroy Special 

Education Records

Date of Notice: 4/20/26

Scheduled Destruction Date: June 19, 2026

Attention: Parents/Guardians, Former Students, and Eligible (Adult) Students

In accordance with district policy and federal regulations (IDEA), notice is hereby given that Deer Creek-Lamont intends to destroy confidential special education records for students who have not received services in this district for seven (7) years or more.This destruction cycle applies to students who graduated, moved, or exited special education services during or before the 2017–2018 school year.

While state law requires a minimum 5-year retention, Deer Creek-Lamont maintains these records for a period of seven years to ensure families have ample time to access documentation. After this period, the records are no longer deemed educationally necessary by the district and will be destroyed to protect student privacy.

These records may be useful or necessary for the student or parent for future purposes, including:

Applications for Social Security or Disability benefits.

Documentation for college accommodations or vocational programs.

Future medical or mental health history.

How to Request Records

If you wish to claim these records before they are destroyed, please submit a request by June 19, 2026.

A valid photo ID is required to retrieve files. If the student is 18 years of age or older, the records must be requested by the student unless legal guardianship documentation is provided.

Note: The district will continue to maintain a permanent record of the student’s name, contact information, attendance, and grades as required by law.
