RESOLUTION R-4-26  /  Utility Bill Extensions

A RESOLUTION ESTABLISHING A UTILITY PAYMENT EXTENSION AUTHORIZATION POLICY AND DELEGATING LIMITED AUTHORITY TO THE CITY CLERK AND ASSISTANT CITY CLERK

WHEREAS,

the City of Attica, Kansas is a city of the third class organized under the laws of the State of Kansas; and

WHEREAS,

the City Council desires to provide a limited and consistent process for granting short-term utility payment extensions while maintaining compliance with the City’s utility billing and service disconnection ordinances; and

WHEREAS,

the City Council finds it necessary to establish reporting and oversight requirements to ensure transparency and accountability;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATTICA, KANSAS:

Section 1. Authorization

The City Clerk or Assistant City Clerk is hereby authorized to grant utility payment extensions to customers of the City of Attica only through the 7th day of the month no later than 5:pm (end of business) in which payment is due.

No extension shall be granted beyond the 7th day of the month unless specifically approved by the City Council.

Section 2. Required Paperwork

Prior to authorization of any utility payment extension:

1. The customer shall complete the City’s designated Utility Payment Extension Request Form.

2. The form must be completed in person at City Hall. No extensions will be approved over the phone or by electronic notification

3. No extension shall be granted without the completed form on file.

Section 3. Limitation on Extensions

No customer shall be granted a utility payment extension if the customer has received three (3) utility payment extensions within the same calendar year.

The City Clerk or Assistant City Clerk shall verify extension history prior to authorization.

Section 4. Discretion

Granting of a utility payment extension is not automatic and remains at the discretion of the City Clerk or Assistant City Clerk, provided all requirements of this resolution are met.

Section 5. Reporting Requirements

The City Clerk or Assistant City Clerk shall submit a monthly report to the City Council detailing utility payment extension activity. The report shall include, at a minimum:

• The total number of extensions granted during the month;

• The number of extensions granted year-to-date;

• Any accounts that failed to pay by the authorized extension date; and

• Any resulting service disconnections.

This report may be submitted as a standalone document or included within the regular Clerk’s report to the City Council.

Section 6. Consistency with Utility Shutoff Ordinance

This resolution is intended to operate in conjunction with Section ___ of the Attica Municipal Code, entitled “________________________”, governing utility billing, delinquency, and service disconnection.

Nothing in this resolution shall be construed to waive, amend, delay, or otherwise alter the City’s authority to disconnect utility services for nonpayment as provided in said ordinance.

Section 7. Nonpayment

Failure to pay the utility bill by the authorized extension date shall subject the customer to service disconnection and applicable fees in accordance with City ordinance and established utility procedures.

Section 8. Effective Date

This resolution shall take effect upon adoption by the City Council of the City of Attica, Kansas.
