RESOLUTION R-5-26  /  Utility Bill FULL PAYMENT

A RESOLUTION ESTABLISHING A POLICY REQUIRING FULL PAYMENT OF CITY UTILITIES WHEN DUE AND LIMITING ACCEPTANCE OF PARTIAL PAYMENTS

WHEREAS,

the City of Attica, Kansas is a city of the third class organized under the laws of the State of Kansas; and

WHEREAS,

the City Council is responsible for establishing policies governing the billing and collection of municipal utility services; and

WHEREAS,

the City Council finds that requiring full payment of utility bills when due is necessary to ensure the financial stability and efficient operation of the City’s utility system;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATTICA, KANSAS:

Section 1. Full Payment Required

All utility bills issued by the City of Attica must be paid in full on or before the due date stated on the bill.

Partial payments shall not be accepted unless expressly approved by the City Council in accordance with this resolution.

Section 2. Prohibition on Partial Payments

The City of Attica shall not accept partial payments on utility accounts except as provided in Section 3 of this resolution.

No City officer, employee, or agent, including the City Clerk or Assistant City Clerk, is authorized to approve partial payments without City Council approval.

Section 3. Council Approval of Partial Payments

A customer requesting to make a partial payment on a utility account must:

1. Appear in person before the City Council at a regular or special meeting; and

2. Formally request approval from the City Council prior to the utility bill due date.

Approval of any partial payment shall be at the sole discretion of the City Council and shall be granted only by affirmative vote.

Section 4. No Waiver of Due Date

Approval to make a partial payment does not waive the requirement that utility bills are due on the date stated on the bill, unless otherwise expressly approved by the City Council.

Section 5. Enforcement

Failure to pay the utility bill in full by the due date, without City Council approval of a partial payment, shall subject the account to delinquency, penalties, and service disconnection in accordance with City ordinances and established utility procedures.

Section 6. Consistency with Existing Ordinances

This policy shall be administered in conjunction with the City of Attica’s existing utility billing, delinquency, and service disconnection ordinances. Nothing in this resolution shall be construed to limit the City’s authority to enforce those ordinances.

Section 7. Effective Date

This resolution shall take effect upon adoption by the City Council of the City of Attica, Kansas.
