These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Harper.

REQUEST FOR RELEASE OF FUNDS

On or after December 1st, 2025, The City of Harper, Kansas will submit a request to the State of Kansas for the release of Federal Funds from the Community Development Block Grant program under Title 1 of the Housing and Community Development Act of 1974, as amended (PL 93-383) to undertake the following project:

Project Name: City of Harper, Kansas, 2023 CDBG Housing Rehabilitation Program Project Type: Housing Rehabilitation of approximately nine houses occupied by qualifying low-to-moderate-income families, approximately three of which will be rental units, six of which will be owner occupied, and the demolition of approximately four vacant dilapidated residential structures

Project Location: A target area bounded by Central Avenue (West) to Highway 2 (East), E. 5th Street (North) to E. 14th Street (South), encompassing both the original and expanded target areas approved by the Kansas Department of Commerce on October 31, 2025.

Estimated HUD/CDBG Funds: $300,000 Estimated Total Project Cost: $336,750

FINDING OF NO SIGNIFICANT IMPACT

The City of Harper has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Harper, 201 W Main St, Harper, KS 67058, and may be examined or copied Monday through Friday, 8 a.m. to 5 p.m.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the City of Harper, 201 W Main St, Harper, KS 67058. All comments received by November 28th, 2025, will be

considered by The City of Harper prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The City of Harper certifies to the State of Kansas that Eric Latta, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of Kansas’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows The City of Harper, Kansas to use HUD/CDBG program funds.

OBJECTIONS TO RELEASE OF FUNDS

The State of Kansas will accept objections to its release of funds and the grantee’s certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the grantee; (b) the grantee has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the State of Kansas; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the Kansas Department of Commerce, CDBG Program, 915 SW Harrison St., Suite 250, Topeka, KS 66612. Potential objectors should contact The Kansas Department of Commerce to verify the actual last day of the objection period.
