AN ORDINANCE AMENDING CHAPTER 8 OF THE MEDFORD MUNICIPAL CODE REGARDING THE REGULATIONS FOR BUILDING, ELECTRICAL, EXISTING BUILDING, FUEL GAS, MECHANICAL, PLUMBING, SWIMMING POOL, FIRE CODE, ENERGY CONSERVATION, PROPERTY MAINTENANCE AND RESIDENTIAL CODES AND ADOPTING APPROPRIATE VERSIONS OF CERTAIN MODEL CODES COVERING SAID MATTERS; MODIFYING THE MEDFORD MUNICIPAL CODE TO AMEND CERTAIN PROVISIONS OF THE ADOPTED MODEL CODES; AUTHORIZING THE MUNICIPAL BUILDING OFFICIAL TO REQUIRE ADDITIONAL PLANNING AND STUDIES WHEN DEEMED APPROPRIATE FOR THE HEALTH AND SAFETY OF CITIZENS OF THE CITY OF MEDFORD; REQUIRING CONTRACTORS IN CHARGE OF STRUCTURAL BUILDING OR MODIFICATIONS TO STRUCTURES TO OBTAIN A PERMIT PRIOR TO PROVIDING SERVICES AND SETTING A FEE THEREFORE; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MEDFORD:
Section 1: Amendatory Language: Chapter 8, Articles II through VI and Articles VIII through XI and Article X111 of the Medford Municipal Code shall be amended as follows:
CODES ADOPTED:
A. Chapter 8, Article II, Section 8-27 shall be amended to read as follows:
The most recent version of the International Building Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
B. Chapter 8, Article III, Section 8-58 shall be amended to read as follows:
The most recent version of the National Electrical Code, issued by the National Fire Protection Association, which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
C. Chapter 8, Article IV, Section 8-77 shall be amended to read as follows:
The most recent version of the International Existing Building Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
D. Chapter 8, Article V, Section 8-98 shall be amended to read as follows:
The most recent version of the International Fuel Gas Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
E. Chapter 8, Article VI, Section 8-125 shall be amended to read as follows:
The most recent version of the International Mechanical Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
F. Chapter 8, Article VIII, Section 8-177 shall be amended to read as follows:
The most recent version of the International Plumbing Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
G. Chapter 8, Article IX, Section 8-205 shall be amended to read as follows:
The most recent version of the International Swimming Pool and Spa Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
H. Chapter 8, Article X, Section 8-234 is amended to read as follows:
The most recent version of the International Fire Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. I. Chapter 8, Article XI, Section 8-265 shall be amended to read as follows:
The most recent version of the International Energy Conservation Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
J. Chapter 8, Article XIII, Section 8-322 shall be amended to read as follows:
The most recent version of the International Residential Code, issued by International Code Council, Inc., which has been adopted and amended by the Oklahoma Uniform Building Code Commission shall be effective for the City of Medford, except as may be modified within the Medford Municipal Code. Such Code is hereby adopted and incorporated by reference as part of the Medford Municipal Code. A copy of the currently active code is available for inspection at City Hall.
Section 2: MODIFICATION(S) OF ADOPTED CODES:
A. General Modifications.
1. Wherever the words “city”, “town”, or “municipality” are used in these codes, it shall mean the City of Medford.
2. Wherever the words “inspector”, “building inspector”, “building official”, or “code official” are used in these codes, it shall mean the municipal official currently assuming the duties and responsibilities of municipal building inspector for the City.
3. All official titles used in these codes adopted shall be interpreted as defined in this municipal code.
4. Violation of provisions of these codes shall be a Class C Misdemeanor triable in the Municipal Court of the city of Medford.
5. All limits referred to in any of the codes adopted by this chapter are hereby established as the corporate limits of the city of Medford, on any real property outside the city’s corporate limits belonging to the municipality, or connection to city utilities.
B. International Building Code Modifications.
1. None.
C. International Residential Code Modifications.
1. Ice barriers required for roofing installations.
a) Table R301.2(1), Row 2, column 6, as found in the 2018 edition, is marked “Yes” to indicate ice barrier underlayment is required.
b) Ice barriers shall be installed in compliance with R905.1.2, as found in the 2018 edition.
c) Ice barriers shall be installed in accordance with State of Oklahoma Amendments (B) and (C) to Section 905.1.2, as found in the 2018 edition.
2. R802.11 Roof tie-down: Minimum uplift resistance requirements. Hurricane ties are required at each intersection of rafter/truss to top-plate. The use of alternate connection types, of equal or greater strength, may be substituted with the permission of the building official.
D. International Existing Building Code Modifications.
E. International Fire Code Modifications.
F. International Fuel Gas Code Modifications.
G. International Mechanical Code Modifications.
H. International Plumbing Code Modifications.
1. To prevent sanitary sewer overflows for Municipal sewer customers, sewer laterals for new connections, significant remodels of fifty percent (50%) or more, and for replacements or repairs made to an existing sanitary lateral shall include:
a. Installation of pop off relief devices (pop off caps) in the caps of all sewer cleanouts on the property.
b. Installation of a backflow prevention device (backwater valve), to prevent sewage from the main sewer backing up into the private sewer lines due to blockages.
c. All installed devices shall be of sufficient size and quality to prevent backflow to individual residences or businesses.
2. Failure to meet the conditions of this subsection effectively exempts the City of Medford from all liability in the event of a sanitary sewer backup.
I. National Electric Code Modifications.
1. The exception to 210.11(C)(3), as found in the 2023 edition, is deleted.
J. International Property Maintenance Code [IPMC] Modifications.
Section 111. Means of appeal. This language in the IPMC is amended as follows.

Section 3: Amendatory Language. Chapter 8, Article I, Section 8-3 of the Medford Municipal Code shall be amended to add a new subsection B that shall read as follows:
B. Structural and/or Load Bearing Work:
1. Every person, firm or corporation, before engaging in the business of serving as a general contractor, concrete contractor, or any other type of work, whether a new build or remodel, that involves structural or load bearing portions of any building within the city, shall pay to the city clerk, through the inspections department, as a registration fee for the purpose of regulating the business, the sums as set by the city council by motion for structural and/or load bearing work payable in advance to be deposited in the general fund of the city. No registration will be granted until proof of registration through the construction industries board as required by the state has been verified. Registration with the city will be from July 1 through June 30 of any year. Registration fees shall be in such amounts as set by the city council.
2. It shall be unlawful for any person, firm or corporation to proceed with any construction, installation, or alteration of structural or load bearing construction project within the city without first having obtained a permit for the particular work from the inspections department. Included in the permit requirement shall be all work that is to be completed at the defined location.
Section 4: Amendatory Language. Chapter 8, Article I, Section 8-3 of the Medford Municipal Code shall be amended to add a new subsection C that shall read as follows:
C. Information On Application: Applications for building permits shall contain all applicable information required on the building permit form, and shall be accompanied by, drawings of the proposed work, showing floor plans, structural details, computations and such additional information as may be required of the applicant by the office of the City building official, this Code or the City Council. When deemed appropriate by the municipal building officer it is prudent to require additional information to ensure the safety of inhabitants of a structure and the citizens of the City of Medford, the municipal building official may require engineer approved plans, storm water drainage studies, soil tests, and any other studies deemed necessary to protect the health and safety of the public.
Section 5: Repealer. All ordinances or parts thereof which are inconsistent with this ordinance are hereby repealed.
Section 6: Severability. If any section, part of provision of this Ordinance is declared unconstitutional or invalid by a court of competent jurisdiction, then it is expressly provided and it is the intention of the City Council in passing this Ordinance that its parts shall be severable and all other parts of this Ordinance shall not be affected thereby and they shall remain in full force and effect.
