RESOLUTION NO. 949-26

A RESOLUTION RESCINDING THE ORDER TO REMOVE OR RAZE THE STRUCTURE LOCATED BEG 408.8 E NW COR GOV LT 7 E 50 S 230 W 50 N 230 TO POB LESS RD R/W SECTION 06 TOWNSHIP 32 RANGE 06 IN HARPER COUNTY, KANSAS, COMMONLY KNOWN AND REFERRED TO AS 607 E. MAIN ST. HARPER, KANSAS, PREVIOUSLY ISSUED IN RESOLUTION NO. 933-25, WHILE MAINTAINING THE FINDING THAT THE STRUCTURE IS UNSAFE AND DANGEROUS AND PROVIDING NOTICE OF A HEARING REGARDING THE CONDEMNED STATUS OF THE PROPERTY. 

WHEREAS, the governing body of the City of Harper, Kansas, previously adopted Resolution No. 933-25 on September 22, 2025, finding that the structure located at:

and commonly known and referred to as 607 E. Main St., Harper, Kansas, was unsafe and dangerous pursuant to K.S.A. 12-1750 et seq.; and,

WHEREAS, Resolution No. 933-25 further directed that the structure be removed and the premises made safe and secure; and, 

WHEREAS, the governing body now finds it appropriate and in the best interest of the City to rescind the prior order requiring the structure to be razed or removed; and, 

WHEREAS, the governing body nevertheless continues to find that the structure remains unsafe and dangerous and unsuitable for occupancy unless and until brought into compliance with all applicable codes and regulations of the City of Harper.  

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF HARPER, KANSAS, THAT:

1. The governing body hereby rescinds the portion of Resolution No. 933-25 directing that the structure located at 607 E. main St. Harper, Kansas, be removed or razed. 

2. The governing body expressly reaffirms and maintains its findings that the structure located at 607 E. Main St., Harper, Kansas, is unsafe and dangerous. 

3. The structure shall remain condemned and shall not be occupied until such time as the owner has obtained all required permits, completed all repairs necessary to bring the structure into compliance with applicable building, housing, fire, zoning and related codes, and the structure has been approved for occupancy by the building official of the City.   

4. A hearing before the governing body regarding the status of the condemned structure and any proposed remediation or compliance plan shall be held on the 22nd day of June 2026, at 6:30 p.m. at City Hall, 201 W. Main St., Harper, Kansas, at which time the owner and any parties of interest may appear and be heard. 

5. Nothing in this Resolution shall prohibit the City from initiating future dangerous structure proceedings, code enforcement actions, or other lawful remedies should conditions warrant. 

BE IT FURTHER RESOLVED, that the City Clerk shall cause this Resolution to be published and shall give notice of the aforesaid hearing in the manner provided by law.
