BARBER COUNTY RESOLUTION NO. 2026-3
A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF BARBER COUNTY, KANSAS VACATING AND ALTERING PORTIONS OF WHITE SANDS ROAD
WHEREAS, The Board of County Commissioners of Barber County, Kansas (Hereinafter “the Board”), is the governing body of Barber County, Kansas (hereinafter “the County”), and is charged with the responsibility of determining whether roads within the County should be laid out, altered, or vacated, pursuant to K.S.A. 68-102 et seq.; and
WHEREAS, the Board has received a Petition praying for an order altering and vacating certain portions of White Sands Road on the grounds that the plated road right of way has been abandoned in certain areas and reestablished in a different location;
WHEREAS, the Board held a public hearing on the Petition in the manner prescribed by law on May 13, 2026, at 10:00 a.m.;
WHEREAS, the Board deems it to be in the public’s interest for economic reasons due to non-use, to vacate a portion of White Sands Road and open a new portion of White Sands road because the platted road right of way has been abandoned in certain areas and reestablished in a different location, pursuant to K.S.A. 68-102;
WHEREAS, that in accordance with K.S.A. 68-102 and K.S.A. 19-101 et seq., the following portions of White Sands Road is determined not to be a public utility by reason of nonuse and lack of necessity for such roads as a public utility does not justify the expenditures of the necessary funds to repair such easement for access or put the same in condition for public travel. As such, said easement for access qualifies for vacation. Furthermore, an additional portion of White Sands Road shall be opened and is necessary for public access and is justified for public utility.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Barber County, Kansas as follows:
1. That the County pursuant to K.S.A. 68-102 has determined it necessary to alter White Sands Road by vacating a portion of White Sands Road described as:
That portion of White Sands Road running west from Sun City Road through the Southwest Quarter (SW/4) of Section Eleven (11), then turning south in the Southwest Quarter (SW/4) of Section Ten (10), continuing into the Northwest Quarter (NW/4) of Section Fifteen (15) where it intersects with existing White Sands Road, all in Township Thirty-one (31) South, Range Fifteen (15) West of the 6th P.M.
and opening a portion of road described as:
A sixty (60) foot road right of way beginning at a point on White Sands Road at the Southwest Corner of the Southwest Quarter of the Southeast Quarter (SW/4 SE/4) of Section Ten (10), Township Thirty-one (31) South, Range Fifteen (15) West of the 6th P.M., then proceeding generally south along the east side of the Northeast Quarter of the Northwest Quarter (NE/4 NW/4) of Section Ten (10), then proceeding generally west along the south side of said NE/4 NW/4, with the entire portion of road contained within the NE/4 NW/4.
2. The Barber County Clerk gave notice of the proposed vacation by publication once in the official county newspaper and by sending notice by certified mail to each owner of property adjoining the easement, at the address where the owner’s tax statement is sent. The Board of Commissioners of Barber County, Kansas held a public hearing on May 13, 2026, concerning the use and/or nonuse of the easement for access, and determined that altering and vacating the easement is in the best interests of the citizens of Barber County, Kansas.
