NOTICE OF PUBLIC HEARING

TO WHOM IT MAY CONCERN AND TO ALL PERSONS INTERESTED:

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Harper Planning Commission on May 20, 2026 at 6:00 p.m. to consider the adoption of amendments to the Zoning Regulations of the City of Harper, Kansas.

PERMITTING ACCESSORY DWELLING UNITS AS A USE BY RIGHT WITHIN ALL RESIDENTIAL DWELLING DISTRICTS WITHIN THE CITY LIMITS OF THE

CITY OF HARPER, KANSAS.

Proposed amendments include, but are not limited to:

CHAPTER 50 ARTICLE I. SECTION 50-5 Definitions

This section to be amended to add the definitions of

Accessory Dwelling Units (ADU) – An ADU is a dwelling unit that is accessory to a principal single-family dwelling unit on the same lot. ADU’s shall be constructed or modified to ensure they do not change the

residential character of the principal use or surrounding area. ADU’s are structures or parts of a structure that provide complete independent living facilities for one or more people, including a kitchen, living room, bathroom, and a bedroom that is:

a. Attached to the principal dwelling or

b. A detached building on the same lot or

c. Within the existing primary structure (internally, i.e. finished basement, single floor).

To be added to:

CHAPTER 50 ARTICLE VII. DIVISION 8. SECTION 50-381(a)

(12) Accessory Dwelling Units

To be added to:

CHAPTER 50 ARTICLE VII. DIVISION 9. SECTION 50-409(a)

(23) Accessory Dwelling Units

a. All ADU’s require the owner of the primary dwelling be a permanent resident of the parcel in which it was constructed (Owner/Occupancy)

b. An ADU may be constructed as a new structure, created by renovating and / or adding to an existing accessory structure located on the same lot, created by constructing an additional home, an entire floor, an attic or basement

c. No ADU shall exceed the size of the primary dwelling and shall follow lot area requirement of Residential Zoning District where permitted

d. Recreational vehicles do not constitute an ADU

e. ADU’s shall have a permanent foundation and any wheels or tires removed

f. Only one ADU is allowed per lot, regardless of lot size

g. Setbacks shall adhere to those required of other accessory structures within the Residential Zoning District in which they are located when constructed as an accessory structure

h. The ADU shall provide a minimum of one off-street parking space, with access to a public street system

i. ADU’s used as short-term rentals shall be allowed through the special use process and shall be renewable every 2 years with no additional fees

Copies of the proposed amendment to the Zoning Regulations are available to be reviewed at the City Clerk’s office at City Hall 201 W. Main St. Harper, Kansas during regular business hours. After hearing the views and wishes of the public, the Planning Commission may close the hearing and consider the adoption of the amended Zoning Regulations and, if adopted, may be referred to the Governing Body of the City of Harper, Kansas for consideration of approval by Ordinances. Said public hearing may be recessed and continued from time to time without further notice.
