NOTICE OF SALE
THE STATE OF KANSAS TO ALL PERSONS CONCERNED:
You are hereby notified that on September 19, 2025, a Journal Entry of Judgment was entered into in favor of ACB Bank (“ACB”) awarding a judgment and foreclosure of ACB’s mortgage liens on the following property, to-wit:
A. Barber County Tracts (all together referred to as the “Barber Co. Tracts”):
1. All that part of the West Half (W 1/2) of Section 10, Township 34 South, Range 10 West of the 6th Principal Meridian, Barber County, Kansas, lying North of the railroad and highway rights of way; and
2. All that portion of the West Half (W1/2) of Section 10, Township 34 South, Range 10 West of the 6th Principal Meridian, Barber County, Kansas, lying South of the railroad and highway rights of way, and also excepting a tract described as follows: Beginning at the Southwest corner of said West Half (W1/2) of Section 10, thence North a distance of 592.68 feet, thence East a distance of 546.48 feet, thence South a distance of 592.68 feet, thence West a distance of 592.68 feet, thence West a distance of 546.48 feet to the place of beginning.
B. Harper County Tracts (all together referred to as the “Harper Co. Tracts”):
1. The Southeast Quarter (SE/4) of Section Twenty-seven (27), in Township Thirty-three (33), in Range Nine (9) in Harper County, Kansas.
2. The Northwest Quarter (NW1/4) of Section Twenty-seven (27) in Township Thirty-three (33) in Range Nine (9) in Harper County, LESS a tract of Twenty-five acres (25A) in a square in the Northwest corner of Section Twenty-seven (27) in Township Thirty-three South (33S) in Range Nine (9) West of the Sixth (6) P.M., in Harper County, Kansas.
3. The Southwest Quarter (SW1/4) of Section Twenty-seven (27) in Township Thirty-three (33) in Range Nine (9) in Harper County, Kansas.
with the Harper Co. Tracts and the Barber Co. Tracts collectively being referred to as the (“Real Estate”).
You are further notified that on December 12, 2025, ACB assigned the Judgment and all rights and title ACB maintained in and to the Judgment to Famous Capital Shoes, LLC, who filed the appropriate notice of such assignment under Kan. Stat. Ann. § 60-2405 in this Case on December 24, 2025.
The amount owed on the mortgages foreclosed on the date of said assignment (December 12, 2025) was $1,311,123.24, plus additional interest that continues to accrue at the rate of $570.94 daily, which is the interest rate provided in the Judgment from and after the date of said assignment, for reimbursement of costs and expenses, and attorney fees incurred by ACB and now Famous Shoes Capital, LLC to exercise this remedy under law.
You are hereby notified that pursuant to an Order of Sale issued by the Clerk of the District Court of Barber County, Kansas, a Sheriff’s Sale of the above-described property will take place at 10:00 a.m. on February 19, 2026, on the steps of the Barber County Courthouse, 118 E. Washington Ave, Medicine Lodge, Kansas 67104.
The sale of the above described real property located in both Harper County, Kansas and Barber County, Kansas will be subject to a redemption period in the amount of three (3) months as provided by law, unless otherwise terminated by Court order under the requirements of Kan. Stat. Ann. § 60-2414(a).
