RESOLUTION NO. 2025-20
A RESOLUTION DECLARING THE EXISTENCE OF NUISANCES CONSISTING OF TREES AND OTHER VEGETATION LOCATED ON PRIVATE PROPERTY WITHIN THE CITY OF KINGMAN, KANSAS, IN VIOLATION OF SECTION 13-306 OF THE KINGMAN CITY CODE, AND PROVIDING NOTICE OF THE GOVERNING BODY’S INTENT TO ABATE SAID NUISANCES IF NOT ABATED BY THE OWNERS WITHIN TEN (10) DAYS.
WHEREAS, Section 13-306 of the Kingman City Code requires property owners to maintain trees, hedges, and shrubs on private property so as not to encroach upon or obstruct sidewalks, streets, alleys, utilities, or public grounds, and to remove any dead, diseased, or dangerous trees or limbs so as to eliminate risks to public safety; and
WHEREAS, violations of Section 13-306 are declared unlawful nuisances and subject to abatement and enforcement; and
WHEREAS, the Governing Body has determined that the trees and vegetation located on the properties listed herein constitute unlawful nuisances within the meaning of Section 13-306.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF KINGMAN, KANSAS:
Section 1. The following properties within the City of Kingman, Kansas, are declared to contain trees and/or vegetation in violation of Section 13-306 of the Kingman City Code, and such vegetation is hereby declared to be a nuisance:
– 425 East B
– 535 East B
– 425 East A
– 427 East C
– 514 East B
Section 2. The owners, agents, or occupants of the above-described properties are hereby ordered to abate the unlawful nuisances within ten (10) days after publication of this Resolution or service of notice, whichever is earlier.
Section 3. If the nuisances are not abated within the ten (10) day period, the City of Kingman, Kansas, through its authorized agents, shall proceed with the abatement, including the trimming, pruning, or removal of trees and vegetation as necessary to comply with Section 13-306 of the Kingman City Code.
Section 4. The costs of abatement incurred by the City shall be assessed against the above-described properties in accordance with Section 13-306 of the Kingman City Code, K.S.A. 12-1617e, and other applicable provisions of Kansas law.
Section 5. This Resolution shall take effect and be in full force from and after its adoption by the Governing Body.
