The Heirs, Executors, Administrators, Devisees, Trustees and Assigns of ANNA L. MARSHALL, deceased, and KARNA SUE BRUEY, deceased; and the Unknown Successors of ANNA L. MARSHALL, deceased, and KARNA SUE BRUEY, deceased,.
GREETINGS:
You and each of you are hereby notified that you have been sued in the District Court of Grant County, Oklahoma, in the above styled and numbered cause, by the above named plaintiffs, in which action plaintiffs have filed their Petition praying for judgment against you, and each of you, determining that the plaintiffs, Irma Jean McCaskill, Trustee of the Revocable Trust of William B. McCaskill and Irma J. McCaskill Dated January 22, 2004, and Allen Keith Shellhammer, are the owners of the following described real estate, to-wit:
Northwest Quarter of Section 25, Township 29 North, Range 6 W.I.M., Grant County, Oklahoma,
and the owners of the following described overriding royalty interest, to-wit:
An overriding royalty interest of I/16th of 8/8ths in and to all of the oil, gas and other minerals that may be produced from the AI #1 Well located in the Southwest Quarter of Section 24, Township 29 North, Range 6 W.I.M., Grant County, Oklahoma, under the terms of that certain oil and gas lease dated December 18, 1984, and recorded in the office of the County Clerk of Grant County, Oklahoma, in Book 388 at Page 236, subject to the termination provisions contained in that certain oil and gas lease covering the Northwest Quarter of Section 25, Township 29 North, Range 6 W.I.M., Grant County, Oklahoma, dated July 26, 1986, and recorded in the office of the County Clerk of Grant County, Oklahoma, in Book 410 at Page 574,
and their respective undivided fractional interests in said real estate and overriding royalty interest are as follows: Irma Jean McCaskill, Trustee of the Revocable Trust of William B. McCaskill and Irma J. McCaskill Dated January 22, 2004, an undivided 1/2 interest; and Allen Keith Shellhammer, an undivided 1/2 interest, and they own such undivided fractional interests set forth above as tenants in common; for further judgment determining the death of Kama Sue Bruey, who was also known as Karna S. Bruey, on December 21, 2023, and determining that her life estate in and to said real estate and overriding royalty interest terminated upon her death; that Allen Keith Shellhammer, Irma Jean McCaskill, Lou Ann Gebhard, Shirley Sweetman, Patty Tidwell, Kathy Schmidt, Dean Bruey, Gail Feely, Abbey Clark and William B. Norris are the sole and only heirs at law of said Kama Sue Bruey; and that the remaindermen and ultimate owners of the above described real estate and overriding royalty interest under the terms of the Last Will and Testament of Anna L. Marshall, deceased, as a result of the death of said Kama Sue Bruey, deceased, were the plaintiff, Allen Keith Shellhammer, and Irma Jean McCaskill; that Irma Jean McCaskill conveyed her undivided 1/2 interest in said real estate and overriding royalty interest to Irma Jean McCaskill, Trustee of the Revocable Trust of William B. McCaskill and Irma J. McCaskill Dated January 22, 2004; and for further judgment determining that the defendants, and each of them, as set out in the caption of this case have no right, title, lien, estate, encumbrance, claim, assessment, or interest, either in law or in equity, in and to the hereinabove described real estate and overriding royalty interest, and cancelling and removing the purported claims of said defendants as clouds upon the title thereto, and quieting and confirming the title of Irma Jean McCaskill, Trustee of the Revocable Trust of William B. McCaskill and Irma J. McCaskill Dated January 22, 2004, and Allen Keith Shellhammer, plaintiffs herein, in and to the hereinabove described real estate and overriding royalty interest; and for further judgment forever barring and enjoining the defendants, and each of them, from ever asserting or claiming any right, title, lien, estate, encumbrance, claim, assessment, or interest in and to the hereinabove described real estate and overriding royalty interest; and for further judgment granting plaintiffs such other and further relief as may be just and proper under these circumstances in law and equity.
You, and each of you, must answer the Petition of the plaintiffs herein on or before the 3rd day of l!!ly_, 2025, or said Petition will be taken as true and judgment will be rendered against you, and each of you, as prayed for in said Petition, and as set forth in this notice.
