RESOLUTION 2026-08 

AMENDING THE ZONING REGULATIONS OF HARPER COUNTY, KANSAS 

TO ESTABLISH REGULATIONS FOR 

COMMERCIAL SOLAR ENERGY SYSTEMS

WHEREAS:

• The Harper County Planning Board has recommended to the Harper County Board of County Commissioners that the Zoning Regulations of Harper County, Kansas be amended to establish regulations concerning Commercial Solar Energy Systems.

• As required by K.S.A. 12-757(b), the Planning Board held a public hearing on the amendment to the Zoning Regulations of Harper County, Kansas establishing regulations concerning Commercial Solar Energy Systems. Public notice of the hearing was published in the official county newspaper on May 7, 2026, more than 20 days prior to the public hearing. The public hearing was held on May 28, 2026.

• As required by K.S.A. 12-757(a), the County is authorized to act on such recommendations.

• The Harper County Board of County Commissioners approves the recommendation of the Harper County Planning Board that the Zoning Regulations of Harper County, Kansas be amended to

establish regulations concerning Commercial Solar Energy Systems. 

TAKING ALL OF THESE FACTS INTO CONSIDERATION, THE BOARD OF COUNTY 

COMMISSIONERS OF HARPER COUNTY, KANSAS, NOW HEREBY RESOLVES THAT THE ZONING REGULATIONS OF HARPER COUNTY, KANSAS ARE AMENDED AS FOLLOWS: 

1.The “Appendix to the Zoning Regulations of Harper County, Kansas: Special Use Application, Review and Approval Criteria for a Commercial Solar Energy System (CSES)”  must be added as an Appendix to the Zoning Regulations of Harper County, Kansas. 

2.This Resolution takes effect after its publication once in the official county newspaper.
