Notice Concerning the Proposed Initial
Kansas Air Quality Class II Operating Permit
Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed initial air quality operating permit. BCE-Mach III LLC – Ricke 5-35-11 2H has applied for an initial Class II operating permit in accordance with the provisions of K.A.R. 28-19-540 et. seq. Emissions of volatile organic compounds (VOC), particulate matter (PM), PM with less than or equal to 10 microns in aerodynamic diameter (PM10), PM with less than or equal to 2.5 microns in aerodynamic diameter (PM2.5), carbon monoxide (CO), oxides of nitrogen (NOX), oxides of sulfur (SOX), and hazardous air pollutants (HAPs) were evaluated during the permit review process. The purpose of a Class II operating permit is to limit the potential-to-emit for these pollutants to below major source thresholds.
BCE-Mach III LLC – Ricke 5-35-11 2H, 14201 Wireless Way STE 300, Oklahoma City, Oklahoma, 73134, owns and operates an oil and natural gas production site located at Section 5, Township 35S, Range 11W, Latitude: 37.022, Longitude: -98.538, Kiowa, Barber County, Kansas 67070.
A copy of the proposed initial Class II operating permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review during normal business hours of 8:00 AM to 5:00 PM at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, and at the KDHE Southwest District Office, 302 W. McArtor Rd, Dodge City, Kansas 67801. To obtain or review the proposed permit and supporting documentation, contact Alexandra Mohn at (785) 291-3683, at the central office of the KDHE, and to review the proposed permit only, contact Ethel Evans at (620) 682-7940, at the KDHE Southwest District Office. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website, https://www.kdhe.ks.gov/413/Public-Notices.
Please direct written comments or questions regarding the proposed permit to Alexandra Mohn, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit decision, written comments must be received no later than noon on May 26, 2026.
A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Alexandra Mohn, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than noon on May 26, 2026, in order for the Secretary of Health and Environment to consider the request.
