RESOLUTION NO. 2025-29
A RESOLUTION FINDING THAT A CERTAIN STRUCTURE LOCATED WITHIN THE CITY OF KINGMAN, KANSAS, AND DESCRIBED HEREIN, IS UNSAFE OR DANGEROUS AND ORDERING SUCH STRUCTURE REPAIRED OR DEMOLISHED AND THE PREMISES MADE SAFE AND SECURE.
WHEREAS, the enforcing officer of the City of Kingman, Kansas, did on the 12th day of September, 2025, file with the governing body of said city a statement in writing that the structure, hereinafter described, is unsafe and dangerous; and
WHEREAS, the governing body of the City of Kingman, Kansas, pursuant to K.S.A. 12-1750 et seq., by resolution duly adopted, fixed the time and place for a hearing and provided for notice of such hearing to the owner, the owner’s agent, lienholders of record, occupants, and other parties in interest, as provided by law; and
WHEREAS, a hearing was held before the governing body on the 11th day of December, 2025, at the time and place stated in the notice, at which the owner, the owner’s agent, lienholders of record, occupants, and other parties in interest were afforded an opportunity to appear and show cause why the structure should not be condemned and ordered repaired or demolished, and the governing body heard evidence submitted by interested parties and the enforcing officer;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF KINGMAN, KANSAS:
1. Findings.
The governing body hereby finds that the structure described herein is unsafe and dangerous and constitutes a hazard to the public health, safety, and welfare (the “Dangerous Structure”).
2. Location / Legal Description.
The Dangerous Structure is located upon the premises legally described as:
The South Sixty-five feet (S 65′) of Lots Eleven (11), Twelve (12), Thirteen (13), and Fourteen (14) in Block Five (5), East Addition to the City of Kingman, Kingman County, Kansas, more commonly known as 602 N. Coronado St., Kingman, KS 67068.
3. Condemnation and Order to Repair or Demolish.
The Dangerous Structure is hereby condemned. The owner of the premises, the owner’s agent, and all other parties in interest are ordered to repair the Dangerous Structure and to make the premises safe and secure. If repair is not feasible or will not abate the unsafe or dangerous conditions, the structure shall be demolished and removed, as determined or directed by the enforcing officer. The repair or demolition shall be commenced within thirty (30) days after publication of this resolution and shall thereafter be diligently prosecuted until completed.
4. City Abatement Upon Noncompliance; Costs.
If the owner fails to commence the repair or demolition within the time stated above, or fails to diligently prosecute the same until the work is completed, the governing body will cause the Dangerous Structure to be repaired or demolished and the premises made safe and secure. The cost of such work, together with the cost of providing notice and any other costs allowed by law, shall be assessed against the property and collected as provided by law.
5. Owner Duty After Demolition.
Upon demolition and removal of the Dangerous Structure, the owner shall fill any basement or other excavation (if any) located upon the premises and take any other action necessary to leave such premises in a safe condition. If the owner fails to take such action, the enforcing officer may proceed to make the site safe.
6. Publication and Mailing.
The City Clerk shall cause this resolution to be published once in the official city paper, and a copy shall be mailed to the owners, agents, lienholders of record, occupants, and other parties in interest in the manner provided by law.
