{"id":102400,"date":"2026-06-10T14:30:47","date_gmt":"2026-06-10T20:30:47","guid":{"rendered":"https:\/\/www.kcnonline.com\/wp\/?p=102400"},"modified":"2026-06-10T14:30:49","modified_gmt":"2026-06-10T20:30:49","slug":"harper-county-resolution-2026-09","status":"publish","type":"post","link":"https:\/\/www.kcnonline.com\/wp\/2026\/06\/10\/harper-county-resolution-2026-09\/","title":{"rendered":"Harper County: Resolution 2026-09"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>BOARD OF COUNTY COMMISSIONERS HARPER COUNTY COURTHOUSE ANTHONY, KANSAS<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>RESOLUTION 2026-09<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>DATE ADOPTED: 6\/1\/2026<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>DATE PUBLISHED: 6\/11\/2026<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A RESOLUTION PROVIDING FOR A TEMPORARY MORATORIUM ON DATA CENTERS INCLUDING ACTIVITIES INVOLVING SUCH SYSTEMS FOR CRYPTOCURRENCY MINING AS WELL AS RELATED ACTIVITIES WITHIN THE UNINCORPORATED AREAS OF HARPER COUNTY, KANSAS; DIRECTING<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">THE REVIEW OF THE HARPER COUNTY COMPREHENSIVE PLAN AND HARPER COUNTY ZONING REGULATIONS CURRENTLY IN EFFECT WITH RESPECT TO DATA CENTER PROJECTS BE REVIEWED AND REVISED TO INSURE EFFECTIVE REGULATION AND ENFORCEMENT IN THE INTEREST OF PUBLIC HEALTH,SAFETY AND WELFARE;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WHEREAS, the Board of County Commissioners, Harper County, Kansas, deems it to be in the best interest of the citizens of Harper County, Kansas to engage in a thorough and comprehensive review of the impact of data centers including activities involving such systems for cryptocurrency mining as well as related activities in the unincorporated areas Harper County, Kansas; and to review the current zoning regulations to determine the necessity of amending the zoning regulations within the county. These types of systems have a combination of high energy density; high energy load factor; may quickly consume all available electrical system capacity; has an energy load that is portable and distributable; highly variable in both growth and reduction as an individual customer or in aggregate; able to relocate quickly in response to short term economic signals; and\/or are highly sensitive to volatile commodity or asset prices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WHEREAS, in accordance with K.S.A. 12-741 et seq. and K.S.A. 19-101 et seq., the County has police power and statutory authority to regulate the conduct of rural development through Zoning Regulations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WHEREAS, due to the unknown number of impacts that data centers including activities involving such systems for cryptocurrency mining as well as related activities might have on property for both current and future property owners, the County believes that such study and review should be undertaken and completed in order to develop appropriate criteria for the location of such projects, if at all; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WHEREAS, it is likely the belief of the County that such investigation may take a significant amount of time to properly evaluate and implement the aforementioned actions by providing for the suspension of applications for Conditional Use Permits for data centers including activities involving such systems for cryptocurrency mining as well as related activities and for the suspension of construction and erection of data centers including activities involving such systems for cryptocurrency mining as well as related activities in the interim due to the County&#8217;s commitment to the best interests of the constituents of Harper County; and<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NOW, THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Harper County, Kansas, as follows:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. From and after the effective date of this Resolution, the Harper County Planning &amp; Zoning Administrator shall not accept nor process applications for the issuance of any Conditional Use Permit, Special Use Permit, or for permits for the erection and construction of any data centers including activities involving such systems such as cryptocurrency mining as well as related activities or components associated with a stand-alone facility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. During this period of moratorium, the Harper County Planning &amp; Zoning Board is instructed to undertake a comprehensive review of the current zoning regulations, including the comprehensive plan, and review of such data centers including activities involving such systems for cryptocurrency mining as well as related projects, including the impact, if any, that such projects might have upon nearby properties. The Planning &amp; Zoning Board is directed to determine whether such projects should be prohibited or allowed in Harper County. If the determination is made that such projects should be allowed, then the Planning &amp; Zoning Administrator is directed to prepare a listing of criteria to be considered by the Harper County Planning &amp; Zoning Board and the Harper County Commission in connection with the review of any future applications for such projects and to recommend such zoning changes or conditions as might be appropriate to mitigate the impact of such projects upon surrounding properties, to provide assurance for the removal of all improvements associated with such projects at the conclusion of their useful life, to propose such other and further conditions, limitations and amendments to the Harper County Zoning regulations, which might best serve the citizens of Harper County, Kansas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. The Harper County Planning and Zoning Department and the Harper County Planning Commission, with the assistance of any consultant retained for that purpose, are directed to review and update Harper County Comprehensive Plan to provide additional guidelines with respect to data centers including activities involving such systems for cryptocurrency mining as well as related activities development in the unincorporated area of Harper County, Kansas; to draft and consider text amendments to the Harper County Zoning Regulations to ensure and in the interest of promoting public health, safety, and welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. The Moratorium imposed by this Resolution may be extended, terminated earlier than its expiration date or otherwise amended by a properly adopted subsequent resolution of this Board of County Commissioners.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. Any provisions of this Resolution which shall be declared by a competent court to be unconstitutional or invalid shall not affect the validity and authority of any other sections of said Resolution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6.
